Using Consumer-Protection Laws to Get Paid and Avoid Claims Denials

Patrick McGuire, Law offices of Patrick J. McGuire, P.C.

This session will discuss the role consumer-protection laws play in the collision-repair industry and the risks of not understanding and complying with such laws. We will take a look at laws and regulations from various states to explain what some of the requirements are (e.g.,. mandatory disclosure forms, signage, third-party notifications) and the penalties different jurisdictions impose for violations (e.g., fines, punitive damages, attorneys’ fees). Rather than just focusing on the negatives associated with non-compliance, however, we will also discuss real-life examples of situations where compliance with such laws greatly benefitted a shop and helped avoid a major crisis. Participants will gain a better understanding of both minimum requirements and best practices for their businesses.
